Terms of Service

These terms apply when you use this website, or when you buy and use a 21press product.

Last updated: [TO CONFIRM: effective date]

1. Who we are

This website and the Delta theme are supplied by [TO CONFIRM: legal entity name], of [TO CONFIRM: registered address]. In these terms, "we" and "us" mean that company. "You" means the person or the organisation that uses our website or our products.

2. Your agreement to these terms

You agree to these terms when you use this website, or when you install or use one of our products. If you do not agree, do not use them.

If you accept these terms for an organisation, you confirm that you have permission to do this.

3. Licence

The Delta theme is free software. It is released under the GNU General Public License, version 2 or later. The GPL gives you the right to use, change, and share the code. Nothing in these terms removes a right that the GPL gives you.

A purchase does not buy the code. It buys a licence key, and that key gives you:

  • automatic updates for the period of your licence;
  • access to support, as described in section 6.

If your licence expires, the software continues to work. You stop receiving updates and support.

4. Purchases and renewals

We use Freemius for licensing and payments. [TO CONFIRM: whether Freemius is the merchant of record, because this decides whose terms apply to the transaction and who invoices the customer.]

Prices are shown before you buy. A licence renews [TO CONFIRM: automatically or manually] at the price shown at the time of renewal. You can cancel a renewal at any time from your account.

5. Refunds

[TO CONFIRM: refund window and conditions. A common policy is 14 or 30 days, no questions asked.]

6. Support

Support covers our products. It does not cover custom code, third-party plugins, server problems, or the content that an agent writes to your site.

Ask for support through the Support page. [TO CONFIRM: a target response time, if you want to state one.]

7. Your site and your content

You own your site and everything on it. We do not.

Delta lets an agent write to your site: pages, templates, styles, and settings. You are responsible for what you tell an agent to do, and for the result. Keep backups. Check a change before you publish it. We are not responsible for content that an agent creates on your site.

8. Acceptable use

Do not use our website or our products to break the law, to attack other systems, or to send unwanted email. Do not try to get around a licence check, and do not resell a licence key as if it were your own.

9. Alpha software

Delta is in alpha. Features can change, and some features are marked unstable in the product itself. Do not use an unstable feature on a site that you cannot afford to break.

10. Third-party services

Our products can connect to services that we do not control. These include payment and licensing through Freemius, WordPress plugins that an integration needs, and AI providers that you connect with your own API key. The terms of those services apply to your use of them. We are not responsible for them, and we do not control their prices or their availability.

11. No warranty

We supply the website and the products "as is". We do not promise that they are free of faults, or that they will meet your needs. This does not remove a right that you have as a consumer under the law that applies to you.

12. Limit of our liability

[TO CONFIRM: this section must be written or approved by a lawyer, because a limit that is too wide is not enforceable in many countries. A usual position is that liability is limited to the amount that the customer paid in the last 12 months, and that indirect loss, lost profit, and lost data are excluded.]

13. Changes to these terms

We can change these terms. We will change the date at the top of this page. If a change is important, we will tell you before it starts to apply.

14. Law and jurisdiction

[TO CONFIRM: the law that governs these terms, and the courts that have jurisdiction.]

15. Contact

Use the Contact page to reach us about these terms.
